The subject of doubts and some controversy has just been elucidated by the Ministry of Economy, through CIRCULAR SEI No. 4081/2020 / ME, which establishes the possibility of companies’ share capital being paid up by cryptocurrencies, with the Commercial Boards accepting and proceeding with the records of acts with such an option. However, when supporting the issuance of securities, although they are not legal tender currencies, they can automatically lend themselves to paying up the capital of the entities, and should be treated as is the case with other movable assets.
