13th Salary: is a worker with a suspended contract entitled to receive?

A lot has changed with this pandemic, everyone had to change their routine, especially in Brazil. How is the 13th with the suspension of the employment contract?

For example, an employee who works in a company and his employment contract was suspended for three months in 2020 due to the pandemic, soon returned to his activities normally for the rest of this year, the period that the contract was suspended will unfortunately not be counted in the 13th due in December.

What happens in this case is that the value of the 13th salary will be reduced proportionally to the months not worked, instead of multiplying by 12, it will be multiplied by 9.

Important point

According to the Labor Law, a period equal to or greater than 15 days is considered for the receipt of the 13th salary, therefore, if in the month in which you had the employment contract suspended, you worked at least 15 days, being so that amount will be counted towards the 13th salary.

How is the salary with the workload reduction?

Sometimes it can happen to affect the 13th salary, in case of reduced working hours and salary, but each case has a different situation, the 13th corresponds to the remuneration of the month of December.

If the reduction in working hours and wages occurs in a period that does not cover this month, the employee will be entitled to the full amount of the 13th salary, if the reduction extends to the month of December itself, for example, then the 13th salary may be reduced proportionally to the remuneration for the month of December.
