Last August, the Judiciary put into operation the new asset search system, called SisbaJud, through which the judge has greater possibilities of searching for debtors’ assets in order to block them for later debt satisfaction.
This new asset blocking system was implemented to replace BacenJud, which allowed the Judiciary to access the Central Bank of Brazil, thus enabling the blocking and unblocking of financial assets in current accounts held by debtors. But only financial assets.
SisbaJud, however, allows the judge to block real estate, furniture, stocks, investments in fixed income securities, as well as broader access to searching personal data of debtors, such as bank statements, credit card bills, check copies, PIS and FGTS statements, foreign exchange contracts and bank account opening contracts.
There will be the possibility of blocking as many assets as necessary until reaching the full amount of the debt.
The new system, which is totally electronic and innovative, will have great applicability in the tax enforcement actions promoted by the Union, States and municipalities, since it came about through a technical cooperation agreement between the Judiciary, the Central Bank of Brazil and the Attorney -General of the National Treasury.
Another great innovation of SisbaJud is the possibility of blocking cryptocurrencies if the investor holds them through a broker, since, with the CPF number of those who invest, the blocking is possible.
In addition, it should be noted that companies that do not hold assets for payment of their tax debts should be careful that there is no redirection of tax foreclosures to those responsible for the company, partners and administrators, since the use of SisbaJud, in this case , may affect the personal assets of said partners or administrators.
According to the National Council of Justice, the new system aims to speed up the processing of cases, make judicial decisions more effective and improve judicial performance.
It is noticed that there is an increasing concern with the improvement of the systems for collecting taxpayers' debts and pledging their assets in the event of default. However, the same does not happen in relation to the simplification of tax legislation, either in the amount of taxes and ancillary obligations, or in the reduction of the tax burden, one of the largest in the world.
